Terms of Use

1. Acceptance of Terms

NdulgeIt, is a service provided by Orel IT LTD (Орел ИТ EOOD) 2 Vasil Aprilov street, 2nd floor, 8000 Burgas, BULGARIA ("the Site Operator", "we," "our," or "us"). By accessing or using NdulgeIt, you agree to comply with and be bound by these Terms of Use.

If you do not agree to these terms, please do not use our services.

2. Description and Definitions

The Site Operator provides a platform ("NdulgeIt, the Site") that allows users to create a custom landing page to house multiple links. NdulgeIt is designed to help users share various web destinations with their audience through a single and unique link.

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

  • "User" refers to any individual who accesses or uses the Site (logged-in or not logged-in).
  • "Visitor" refers to a user who accesses the Site without being logged-in.
  • "Creator" refers to a user who accesses the Site logged-in by using an account with an extended level of service and who, can create link-in-bio pages and share them around the web.
  • "Supporter" refers to a Visitor who makes a voluntary monetary payment (a "Tip") to a Creator through the Tip Jar feature.
  • "Cookies" refers to small files that are placed on your computer, mobile device or any other device.
  • "Personal Data" refers to any information that relates to an identified or identifiable individual.
  • "Payment Information" refers to any necessary information required for financial transactions, which may include legal Name and Surname, Address, Credit Card Number, Tax Identification Number (TIN), Value Added Tax number (VAT), Bank Account, and IBAN number. This does not mean that all of this information is always collected.
  • "Third-Party" refers to any partner the Site Operator have a contractual agreement with, for the purpose of making the Site fully functional and profitable.

3. Eligibility

You must be at least 16 years old to use NdulgeIt. By using NdulgeIt, you represent and warrant that you are at least 16 years old.

4. User Accounts

4.1 Account Creation

To create a Creator profile on NdulgeIt, you are required to provide a valid and up-to-date email address. You agree to ensure that the email address provided during the registration process is accurate and current.

4.2 Account Security and Multi-Account Policy

You are responsible for the security of your account and ensuring it is used only in a lawful manner. We recommend that you create a strong password and do not share it with anyone. If you think your account has been compromised, please contact us immediately. You must not assign or transfer your account to someone else or use your account (or allow it to be used by anyone) in a way which, in our reasonable opinion, causes damage to NdulgeIt or our reputation, or infringes another’s rights or applicable laws and regulations. You also agree that you will not use automated devices such as bots or scripts to create multiple accounts.

Furthermore, Creators are limited to maintaining one (1) account per individual. The creation of multiple accounts (commonly known as "sock puppetry") for the purpose of manipulating search engine results, increasing affiliated link volume, circumventing content restrictions, or engaging in spam or fraudulent activity is strictly prohibited and constitutes a material breach of these Terms.

5. Subscription Plan

5.1 Free NdulgeIt

Most of our services are free to use. However, we offer a subscription plan, for those who want to be "Independant", that provides the exemption of our Monetization System and, the removal of our logo on your link-in-bio page.

5.2 Monetization System

For Creators, our business model involves the collection of your voluntarily provided Personal Data. We may cross-reference your Online Persona from the links you add to our platform. We do not collect Personal Data that is not publicly accessible about you; instead, we focus on analyzing your Online Persona. This information may be used to create partnerships with Third Parties or to offer you more targeted advertising on our platform.

By using our services, you agree to the collection and use of your publicly available data for these purposes. Our goal is to enhance your experience and provide you with more relevant content and opportunities.

For Visitors, this may involve clicking on affiliated links, for which we may earn a commission from Third Parties.

5.3 Subscription Terms

By subscribing to our "Independant" plan, you agree to pay the specified fees. Subscriptions are automatically renewed unless canceled. You can cancel your subscription at any time through your account settings.

Subscribing to our "Independant" plan will exempt you from our Monetization System and remove our logo from your Creator page.

6. Tip Jar and Payment Services

6.1 General

NdulgeIt offers a "Tip Jar" feature that allows Creators to receive monetary tips from their Supporters. This service is facilitated through our third-party payment processor, Stripe, Inc. ("Stripe"). By using the Tip Jar feature, you agree to be bound by these terms in addition to the other terms outlined in this document.

6.2 Stripe Connected Account Agreement

To receive payments via the Tip Jar, you must register as a Creator and create a "Stripe Connect" account. The creation and management of this account are subject to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement (collectively, the "Stripe Terms"). By enabling the Tip Jar feature, you agree to be bound by the Stripe Terms, which may be modified by Stripe from time to time. As a condition of NdulgeIt enabling payment processing services through Stripe, you agree to provide NdulgeIt with accurate and complete information about you and your business, and you authorize NdulgeIt to share it via the processing services provided by Stripe.

6.3 Our Role and Fees

NdulgeIt acts as a technology platform to facilitate transactions between Creators and Supporters; we are not a bank, financial institution, or charitable organization. All funds are processed by Stripe and are transferred directly from the Supporter to the Creator's Stripe account. NdulgeIt does not hold any funds. We charge a platform fee on each transaction, as detailed on our front page and within your store settings. This fee is automatically deducted from the amount paid by the Supporter.

6.4 Creator Responsibilities

As a Creator using the Tip Jar, you are solely responsible for:

  • Fulfilling any promises or obligations made to your Supporters in exchange for their tips.
  • Accurately calculating and remitting all applicable taxes (such as income tax, VAT, or sales tax) on the funds you receive to the appropriate authorities.
  • Handling all disputes, refunds, and chargebacks initiated by your Supporters. You agree that you are financially responsible for all such chargebacks and associated fees.
  • Ensuring your use of the Tip Jar complies with all applicable laws and regulations in your jurisdiction.

6.5 Supporter Acknowledgment

Supporters acknowledge that all tips are made voluntarily. Unless a Creator has explicitly offered goods or services in exchange for a tip, payments are considered gratuities. Payments are processed by Stripe and are final and non-refundable, except where required by law.

7. User Content and Prohibited Links

7.1 Content Responsibility

Creators retain full ownership of any content they submit, post, or display through NdulgeIt. By submitting, posting, or displaying content, you grant the Site Operator a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods.

7.2 Prohibited Content and Abuse

Creators agree not to post, upload, or transmit any content, or links leading to any content, that:

  • Is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, racially or ethnically discriminatory, or otherwise objectionable.
  • Display explicit adult content directly on NdulgeIt, even though you may use NdulgeIt to link to adult-related content, websites, or services.
  • Links directly or indirectly to illegal or unauthorized gambling sites, pyramid schemes, "get-rich-quick" schemes, financial scams, malware, phishing sites, or any content deemed illegal in the jurisdiction of Bulgaria.
  • Constitutes unsolicited advertising, junk mail, mass commercial email, or "spam" designed to generate affiliate revenue through deceptive or bulk practices, including creating multiple identical or near-identical profiles for the sole purpose of link farming or keyword spamming.
  • Contains or links to Child Sexual Abuse Material (CSAM) or non-consensual sexually explicit content.
  • Aims to circumvent any restrictions, fees, or security measures put in place by NdulgeIt or its Third-Party partners (including Stripe).

8. Intellectual Property

NdulgeIt and its original content, features, and functionality are owned by the Site Operator and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

9. Cookies

We use cookies to improve your user experience and collect information about your use of the Site. Cookies are small data files that are stored on your device and allow us to recognize you as a Creator. By creating an account on NdulgeIt, you consent to the use of tracking cookies. Make sure to consult our Privacy Policy for more information.

We do not use any cookie when browsing the website as a Visitor but Third Parties may, when clicking on Creator(s) link(s).

10. Termination and Enforcement

We may terminate or suspend your account and bar access to NdulgeIt immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

10.1 Enforcement for Abuse and Fraud

If the Site Operator determines, in its sole discretion, that a User has engaged in prohibited activity, including but not limited to creating multiple accounts (Section 4.2), link spamming, or linking to fraudulent or illegal content (Section 7.2), the Site Operator reserves the right to:

  • Immediately and permanently terminate all associated user accounts.
  • Investigate the User's activities and cooperate with law enforcement authorities as required.
  • Immediately disconnect or reject the associated Creator's Tip Jar (Stripe Connect) account, thereby disabling the Tip Jar feature on NdulgeIt. Users acknowledge that NdulgeIt does not hold funds and that the withdrawal of any existing balance must be handled directly through their third-party Stripe account.
  • Pursue legal action for damages caused by the fraudulent activity, including recovery of costs associated with investigation and compliance.

11. Disclaimer of Warranties

NdulgeIt is provided on an "as is" and "as available" basis. The Site Operator makes no representations or warranties of any kind, express or implied, as to the operation of NdulgeIt or the information, content, materials, or products included on NdulgeIt.

12. Limitation of Liability

In no event shall the Site Operator, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to, or use of, or inability to access, NdulgeIt.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
